SAT publishes first amendment to the Miscellaneous Fiscal Resolution 2020

In this modification, the value of the Password is recognized as an electronic signature, which it replaces. The Tax Administration Service (SAT) published this Tuesday in the Official Gazette the First Resolution of Modifications to the Miscellaneous Fiscal Resolution for 2020 in which it recognizes the Evidentiary Value of the Password. Exposes that for the purposes of article 17-D of the Fiscal Code of the Federation (CFF), the Password is considered an electronic signature that functions as an access mechanism in the services provided by the SAT through electronic means, consisting of the password in the taxpayer’s RFC, as well as by a password that he himself chooses, which can be changed through the options that the SAT has for such purposes by electronic means. The SAT specifies that it may require additional information and documentation that can reliably prove the identity, domicile and, in general, the tax situation of the applicants, legal representatives, partners or shareholders, delivering the “Acknowledgment of request for additional information, related with your tax situation. ” Applicants who are located in the case indicated in the previous paragraph, will have a period of six days from the day after the presentation of the request to generate and update the Password, to clarify and display the documentation for the conclusion of the procedure in accordance with the procedure file 197 / CFF ‘Clarification in the requests for procedures of Password or Certificate of e.signature’, contained in Annex 1-A, in the ADSC in which the aforementioned procedure began or the electronic means that the SAT determines in its case. It adds that taxpayers individuals of legal age registered exclusively in the Regime of Wages and Wages and Income Assimilated to Wages, may submit the request to generate or update the Password through the SAT ID mobile application, meeting the requirements provided in the processing sheet 7 / CFF ‘Request to generate and update the Password’, contained in Annex 1-A. “The Password replaces the autograph signature and produces the same effects that the laws grant to the corresponding documents, having equal probative value,” he stresses. The tax authority warns that in the event that the Password does not register activity for a period of four consecutive years, the SAT may block it due to inactivity, so the taxpayer must once again carry out the process of generating the Password through the SAT Portal with its current e. signature.
